If You Are Charged with DWI in the State of Alabama

Fine amount can be from $600 to $2100.

The driving License shall be suspended for 90 days.

Alcohol Education or Treatment:

A detailed evaluation and assessment of the convicted offenders shall be carried out to determine the extent of their alcohol problems. This assessment is not free and usually the offenders pay a fee upto $50.

Based upon the assessment, a treatment is recommended and all the offenders undergo this mandatory treatment program.

A court referral officer monitors the treatment plan of the offenders who are convicted in the repeated offence. These offenders undergo an intensive treatment program.

The terms of the treatment program make it mandatory for offenders to follow their treatment program, failing which they have to reappear before the court and their driving license is not reinstated.

First time Offence by Under 21 Having BAC between .02% and .08%:

License is suspended for 30 days

In case the offender is a juvenile (under 18), he may be imposed with delinquency dispositions that may include fine and Completion of DWI/Substance Abuse Court Referral Program

First time Offence by Under 21 Having .08% BAC and over:

Generally, DWI Fines only; but if under 18, may utilize other juvenile dispositional alternatives.

Commercial Vehicle Drivers (First Violation):

For a BAC of .04 or more, 1 year License suspension and in case fail to submit to test, 2 years suspension is awarded

Day Care and School Bus Drivers - .02% BAC or more (first offense):

License suspension for 1 year

$600 - $2100 of fine and/or

Less than 1 year imprisonment
