Colorado DWI Laws and Drunk Driving Information

A person cannot drive in the state of Colorado while under the influence of alcohol or drugs. A Blood Alcohol Content (BAC) Limit has been placed above which it is considered unsafe for a driver to be driving a vehicle.

The Colorado state has set BAC limit of 0.08. Above this limit, it is considered an offence by a driver to drive a vehicle and a driver can be arrested and subsequently convicted of DWAI.

Colorado has also set a lower limit of 0.5 where a driver is only considered to be driving while ability impaired and can be arrested and possibly convicted of DWAI. The law enforcement officer has the authority to request a driver to willingly submit to field sobriety tests, also known as breath test. The Colorado state has the right to use these test results in any criminal prosecution for DWI or DWAI. These tests can also be used for the purposes of an administrative license revocation.

The drivers who are convicted of DWI or DWAI shall:

Complete a community service

Shall pay fines and court costs

In most of the cases, the drivers are offered probation and terms of this offer may vary from case to case basis. In case a driver is caught with a BAC over 0.08, his license may also be revoked by the Colorado Department of Revenue. However, the state allows you to allow for a probationary license, and you can use that while driving to and from work.

You must know that this penalty is in addition to the other charges and your attorney will have to fight this offence separately, even if you are able to get the DWI charge dismissed completely.
