Regulations for DUI/DWI in Delaware

In Delaware, following Blood Alcohol Content (BAC) limit is set:

0.08% for drivers over 21 years of age

0.02% for drivers under 21 years of age

A chemical test result of above 0.05% can also lead to a DUI arrest

For commercial drivers, the limit is set at 0.04%.

The law of "implied consent" is applied in the state of Delaware. It simply means that having a Delaware license automatically provides your consent to be tested if stopped by a law enforcement officer, while driving. The BAC is checked through a breath test or by an actual blood test. Refusing to take the test will result in your license being revoked:

1 year for a first offense

18 months for the second offense

24 months for the third subsequent offense, besides the penalties for DUI

Points will be added to your driving record and your license will be suspended or revoked, if you convicted of DUI/DWI.
