Iowa DWI Laws
Operating while under the influence (OWI) does not only endanger you but it also negatively effects people around you. If you are caught for operating any vehicle while intoxicated, you can be charged with an OWI in the state of Iowa. It is according to the Iowa law that if your blood alcohol concentration is more or equals to 0.08%, you will be arrested.
Implied Consent Law and consequences for offenders
According to this law, you are to submit a test for blood, breath or urine if the officer believes that you have been driving while drinking. If you refuse, your license will be taken instantaneously for two to three years and you will be needed to attend a drunk-driver course. Consequences for the offenders may be high penalties such as heavy fines and required counseling.
If you are convicted for the OWI for the very first time, you might end up in jail for one year. A fine of $1000 and your driving license will be taken for six months.
You will lose your license for two years, will be jailed for two years and will be fined $1500 to $5000 if you are caught for the second time within 12 years.
If caught for the third time within 12 years, this will cause five years in jail, a $2500 to $7500 of fine and you will lose your license for six years. Iowa law requires that you have to pay all the fines on your own and have to take a course for drinking drivers. In addition you will be hit with a $200 fine for restitution fund. If you are again caught while your license is revoked, you will pay a fine of $1000.
If you are a Iowa resident, it is important for you to realize that OWI convictions can determine whether it is your 2nd or 3rd offence.
Getting your license back
In order to get your license back, you need to show your financial responsibility by filling a specific insurance form and you will also be tested for different driving tests. An OWI license revocation will remain your driving record for 12 years.
