Kentucky DWI Laws

Kentucky legislators are very strict when it comes to driving while under the influence of alcohol or any drug that impairs your driving ability. A drunk driver is not only putting his own life at risk, he's also endangering the lives of everyone around him.

If you drive under the influence (DUI) of drugs or alcohol in Kentucky, you may face following consequences:

Risk losing your driving privileges

You also risk having your license plate confiscated and having an ignition interlock device installed in your vehicle.

In Kentucky, you are driving illegally if your blood alcohol content (BAC), which is the amount of ethyl alcohol in your blood, is .08% or higher. If you're under the age of 21, the BAC limit is .02% per the Zero Alcohol Tolerance rule, and for commercial drivers, it is .04%. You must know that aside from alcohol, driving can be impaired by prescription, over-the-counter, and illegal drugs as well as inhalants such as glues, sprays, and gasoline.

In the state of Kentucky, Implied Consent Law is applied which states that anyone operating a motor vehicle, is deemed to have given consent to blood, breath, urine, or combination tests in order to determine the driver's BAC. Never refuse the tests. If you refuse any of the tests, your license could be immediately suspended from 30 days to five years, regardless of whether or not you're actually convicted of the DUI.
