Nebraska DWI Laws

Responsible for the majority of the auto accidents involving death and injury, in Nebraska, are
the drivers under alcohol influence. While under the influence of any illegal drug, driving is
prohibited by law. If you are above the age of 21 and are drunk, you are legally forbidden to
drive with a BAC of 0.08% or higher. Essential skills, at this level, become impaired. The person
who has consumed alcohol is more likely to get involved in any accident compared to the one
who is not intoxicated. Nebraska’s “zero tolerance” law forbids you to drive with any alcohol in
your system if you are under the age of 21. You’re likely to feel the negative effects of excessive
drinking if you are an inexperienced driver. Since, the body of a teen driver processes alcohol
differently than an adult driver’s.

Implied consent law

Nebraska’s implied consent law says that if you are driving on Nebraska’s roadway, you have
agreed to give chemical test requested by an officer. Refusal to take the test will result in the
same punishment as someone found driving under alcohol influence.

Sentence for DUI

Each year in Nebraska, 14,000 drivers are arrested for drunk driving. However, sentences vary
for convicted drivers.

License reinstatement

Before you can receive a new driver’s license, you’ll need to provide proof of financial
responsibility. This is done by submitting an SR-22 to Nebraska Department of Motor Vehicles.

Ignition interlock restricted license

On a third DUI offense, you will be restricted from driving for 15 years. However, after this you
may be able to apply for an ignition interlock restricted license.
