A DWI or DUI in the State of Nevada is a serious offense and carries severe penalties.

 

BAC limit

The BAC limit in Nevada is .02% for under 21 years of age drivers .04% for commercial license
holders, and .08% for everyone else. The BAC only applies to alcohol and other drugs.

 

DUI laws

Because BAC limits are just a reference, you can be arrested for any detectable amount of
alcohol in your body. You must submit to BAC testing when requested. If you resist you may
be arrested. It is illegal to drive with open alcoholic beverages. If you are DUI with a passenger
under the age of 15, your penalties will be harsher.

pay fines and much more. Consequences may be more severe for subsequent offenses. Penalties
can be harsher for young drivers and commercial drivers.

 

First conviction:

• Driver’s license taken for 90 days

• Jail sentence or community service

• Fine of $400-$1000

 

Second conviction:

• Driver license taken for a year

• Jail time or home arrest

• Fine of $750-$1000

• 100-200 hours of community service

• Car registration suspension

• Order to attend education class or clinical supervision for a year

 

Third conviction:

• License taken for 3 years

• Prison sentence for 1-6 years

• Fine of $2000-$5000

• Car registration suspension

 

DUI causing death or injury:

• License taken for a year

• Prison sentence for 2-20 years

• Fine of $2000-$5000
